Terms of Service

These Terms of Service ("Terms") govern your access to and use of the CartSDK platform, storefronts, dashboards, and APIs (the "Service") provided by DeepMerchAI, LLC ("CartSDK", "we", "us"). By using the Service you agree to these Terms.

1. The Service

CartSDK lets merchants build and operate online storefronts — products, themes, cart, checkout, and a merchant admin — on their own domains. Features may change over time.

2. Accounts

You are responsible for the accuracy of your account information, for safeguarding your credentials and API keys, and for all activity under your account.

3. Acceptable use

• Do not use the Service to sell unlawful goods or to violate any law or third-party rights.
• Do not attempt to disrupt, reverse engineer, or gain unauthorized access to the Service.
• Do not upload malware or content that is fraudulent, infringing, or abusive.

4. Merchant responsibilities

As a merchant, you are solely responsible for your store's content, products, pricing, taxes, fulfillment, customer service, and compliance with applicable laws. CartSDK is a technology provider and is not the seller of merchant goods.

5. Fees & billing

Paid plans and usage-based charges, where applicable, are billed as described at sign-up. Payment processing is handled by third parties (e.g., Stripe) under their terms.

6. Third-party services

The Service integrates third parties such as Stripe (payments), Shippo (shipping), Cloudflare (delivery/storage), and Replicate (AI). Your use of those features is also subject to their terms.

7. Intellectual property

CartSDK and its underlying software are owned by DeepMerchAI, LLC. You retain ownership of your own store content; you grant us the rights needed to host and operate it for you.

8. Disclaimers

The Service is provided "as is" without warranties of any kind, to the maximum extent permitted by law.

9. Limitation of liability

To the maximum extent permitted by law, DeepMerchAI, LLC will not be liable for indirect, incidental, or consequential damages, or for lost profits or data, arising from your use of the Service.

10. Termination

You may stop using the Service at any time. We may suspend or terminate access for violations of these Terms or to protect the Service.

11. Governing law

These Terms are governed by the laws of the United States and the state in which DeepMerchAI, LLC is organized, without regard to conflict-of-law rules.

12. Changes

We may update these Terms; continued use after changes constitutes acceptance. Material changes will be posted here with a new "Last updated" date.
